In the case Quanta Computer v. LG Electronics, ___ U.S. ____, 128 S.Ct. 2109 (2008), the United States Supreme Court clarifies and expands upon its holding in United States v. Univis Lens Co. In Quanta, the court clarified that the same analysis applies to process or method patents, not just product patents: When a component substantially embodies the process and cannot be used for any purpose other than to practice the patent, the process patent is exhausted upon sale of that component.  The decision makes it more difficult for patentees to extract royalties from multiple parties for the same device.

Under the Copyright Act, a registered copyright owner can elect to recover statutory damages for infringement instead of actual damages, which can be difficult to prove. Section 412 of the Copyright Act, however, limits the availability of statutory damages for pre-registration infringement. In Derek Andrew v. Poof Apparel, 528 F.3d 696, (9th Cir. 2008), the Ninth Circuit court joins the Second, Fourth, Fifth and Sixth Circuit courts in barring statutory damages for ongoing infringement — continuing infringement that occurs both pre- and post-registration.

Car insurance provides compensation to another person in the event that you are found to be liable to that person damages. Your liability insurance not only protects your personal assets. It also provides coverage for you and your passengers if you have the misfortune to be injured in a collision with someone who only has the minimum coverage of 25/50/20 or someone with no insurance at all.

Technically Virginia does not require car insurance. The reality is that you can be charged criminally if you do not have at least the minimum insurance or the equivalent.

Jerry N. Jones v. Harris Associates, 527 F.3d 627 (7th Cir. 2008), was one of about a dozen cases brought in 2003 and early 2004 based on the “excessive fee” provisions of the Investment Company Act of 1940. In the case, a group of individual investors claimed that Harris Associates, manager of the Oakmark funds, charged excessive fees to individual investors in violation of the Act. The Seventh Circuit Court of Appeals affirmed the lower court’s judgment dismissing the claims against Harris Associates, holding that the market, not the judiciary, should determine manager fees.

The truth is, however, that despite accepting and investing their insureds’ premiums for years before, the insurance industry continues to seek any and all means to avoid paying on these claims. Unfortunately, it appears that the insurance industry’s negative response to legitimate claims is not limited to tragic events, where the company is faced with claims that it may not be able to afford. Since I empathize with those people whose legitimate claims were and are denied, I have compiled the following list to help negate some of the most prevalent bases upon which insurers rely to deny claims.
